Additional Enquiries before contract [planning permision] [neighbour hood]

Q:Any help appritiated.

A question has come up in a sale im involved in that asks

"has the seller become aware of proposal or to develop adjioning or land

Can any one clarify the neighbourhood land bit ?

ie what does this include ? the street ? the postcode? a certain distance ?

A:Never answer any question with the expression "not aware" because it implies that not only has the seller no knowledge of the particular thing but also that he has made reasonable inquiries about the matter. Most people haven't made such inquiries so "not aware" is a dangerous expression.

On the particualr point would it not be better to say something like "The seller does not know of any proposed building work…"?

I do find it difficult though to understand what is so bad about a park. Can OP explain?

A:when you say park do you actually mean nightmare-park of skateboardland for chav monsters?

You could respond "I am not aware of any planning developements on my street" – that'd be truthful and avoids anything about the park.

We have a situation here where we on are on the border of two local authorities – so I can see how a situation might exist where you wouldn't be asked for consultation no PP but things might affect your house.


A:I can't see the problem. If anything the establishment of a park would increase the property's value.

In any case, 'development' normally means building work of some kind. Speak to your solicitor.


A:Unfortunatly for me ~I have been a good citezen and involved in the planning of the park from a local home owners piont of view so there is no way to deny my awareness of the development and I wouldnt do this.

I to agree it is there responsibility so I dont want to be dishonest but dont want to mention it if I dont need to.

I think the answer of unaware of anything in the postcode, estate or street achives this, would you agree ?

What are the negatives of answering the question in this way ?


A:If you're going to say anything, just be honest. But its their solicitor's job to check the planning situation anyway. How is the buyer supposed to prove the vendor was aware of a proposed development down the road?

A:Thanks for the advice, am going to speak to solicitor tomorow but plan to answer the question in a very sepcific manner as the proposed development ( park) is near my propety but nit in the same postcode, street or estate. So plan to answe the question that the i am unaware of any development or proposed development within my postcode, estate or street.

any comment on this as an answer?


A:Just say, "Cannot answer as question not specific enough. Purchaser should make their own enquiries of the planning department" and leave it at that. Or even better, ask your solicitor to help word a response.

The devlopment is about 6-8 months away. I need to understand my legal position with regards to the question as it is obviuos I know about it if they were to look into it.

It is merely a conversion of waste land into a park not a building development, its not that I dont want them to know but dont want to state it unless I have to.


A:how far away is the planning development you don't want to let them know you know about?
