Q: We have moved to new premises since April last year we have problems with moisture in the living room and bedroom have. We were meant to move into the flat in December 2005 but there was a fire and we think that the reason for the moisture in the wall is still holding water from fire fighting. The company building the properties off the record told us that we need to sell or the solicitation is rehoused by the developer (George Wimpey). Any advice would be welcome, we need an independent surveryor look like?

A:You should contact the developer and report it as a defect. They have to address and sort the issue as its within the first two years defect and snagging period. If they do not address the problem or acknowledge it go to the NHBC/Zurich or whoever provided your new build guarantee, who will (or should) force to Developer to sort out. If the problem isnt reported to the developer within the two years you will have a right on your hands to get it sorted. Do not attempt to sort out the problem yourself or you will invalidate the developers guarentee.
