So close and yet so far . [vacant possession] [first time buyer]

Q: Agggghhhhhhh!

Im the purchase of a freehold house (Fri owned) and the sale of a leasehold flat for a . Offers were made and accepted to approximately February 15, and the lawyers are all still doing their stuff. How long does it take?

Im be kept reasonably in the picture – there are problems on both sides with a matrimonial home my account purchase, applications for building permits is irrelevant, and confusion over who the owner or management agent was responsible for answering my questions.

That purchasers solicitor makes approximately 10 weeks to date, and as I understand that we are still awaiting answers from the management company to the buyer questions.

Every days my lawyers, I am more and more nervous that I will lose either my purchaser, the place where I buy, or both! Im up trying to chase things, nobody calls back, or say we are ready for this “or” it is forwarded to that department and that, and I just want to work.

Im just keep one nervous revenge to the point of affecting my health now, I wake up in the middle of the night and just think of all those involved in any transaction that my emotional involvement with, or succeeds or fails. I think how their actions (or lack of) to fully determine the future direction of my life, and how dare they hold of something so important to me. Then I became angry and feel that I want to give and Just out.

I realize that his self-destructive thought patterns, but Im only human after all draw. I can not be the only one who has felt like this, can I?

Amazingly, my leasehold sale has come together before my freehold purchase – all down to the matrimonial home charge. I heard from the estate agent that it had been released but we still await official confirmation to my solicitors.

It has been one thing after another so far. On my purchase, the deeds took ages to show up which put back searches and that sort of thing, and on my sale there have been complications because my freeholder and management company have split up responsibilities into separate operating companies :rolleyes: so my buyer's solicitors enquiries were getting bounced all over the country.

Instructions happened around Feb 12th, and we're now aiming for completion on May 10th – bringing it all in at 12 weeks. I thought i'd post this because i've found comfort in learning of other people's conveyancing trauma through this site; and it might just help someone else understand what could be going on with their case!

I've emailed my solicitor and asked him to note that I would not like any more surprises.

A:Id agree. When buying our flat it took 5mths because of alot of leasehold related wrangling I just hope we dont suffer the same now we are selling it!!

A:Thanks guy – i've heard the 14 week figure come up quite a bit reading about leasehold conveyancing. We're at 10 weeks so far; and assuming my sol has everything in place tomorrow I don't know how quickly they can move things along from there…

A:My last property was leasehold, which I sold to buy a freehold house. Where leasehold property is concerned it has always taken between 12-14 weeks from offer to completion in my experience.

Because there is a bit more involved when buying a leasehold property there are various queries that need to be cleared up as part of the process & unfortunately it often is just a case of having to wait for the queries to be answered by the relevant departments or persons.

I promised my solicitor I wouldn't bug him again until tomorrow which is when the management company have promised to get their standard information to him. After that I presume that it has to be forwarded to my buyer's solicitors for them to accept the information and agree that we can move forward to exchange…


A:Our vendors moved out around 20th March. In to rented apparently (although I have a feeling their staying with family).
As far as I'm aware, they haven't been chasing at all – which is a relief – as we would hate to lose that house.

Gonna try to get through to my solicitor again now…. wish me luck!


A:Must be doubly frustrating having been all ready to exchange on your purchase!

"Luckily", my freehold purchase has been delayed because of the matrimonial home charge which was only cleared last week; and still needs to be confirmed by the vendors solicitors. If the vendor was getting impatient I don't know how i'd be feeling!


A:Blimey, this is almost the exact same story as me! We are selling our leasehold ex-LA flat to a TFB, and buying a vacant freehold house. Our offers were made/accepted on 12th Feb.

We were hoping to be all done by Easter (us and our vendors have been ready with signed contracts since 26th March!!) – but it's just our buyers solicitor holding us up.

You'll see my moanings and whingings elsewhere on this board about him, but it's really starting to get us down now!
It's not so much the timescale that's bothering us, it's our buyers solicitors consistent lying about dates when he'll be ready to exchange.

Plus my wife is 6 months pregnant, and the new house needs a LOT of work doing before we can move in (we'll be sleeping at my parents for a couple of weeks first) – new bathroom, kitchen, redecorating, removal or original coal shute, reopening doorways etc. etc.

I know how frustrated you must feel – but you must keep on chasing. I've been emailing our buyer, our solicitor, and phoning our EA on almost a daily basis. I think they get so sick of you that they'll do anything to get things moving……

Chin up – it'll all come good in the end…. thats what I keep saying anyway!
