Supplement on Tuesday, garage roof off [asbestos roof] [exchange contracts]

Q: We move into our new home Tuesday. Last week we discovered that one part of the garage roof was missing. It is a sloping roof of asbestos and the bottom third of one of the plates at the front was during the recent storms. They said that they get it fixed, but not so far. I have no idea exactly when it happened – was the big storm the night before we , but evidence? So I have no idea where the insurance would cover it, and if its ours, we have a number of claims due to damaged window – 3 claims, and a 4th one much larger, well, I do not know how feel about that,

suggestions?
And suggestions for repairing, even if bodged? Wrong forum I think, but it would save money!

A:I would have your solicitor contact theirs. He may suggest retaining some money until you work it out with them.

Although you have insurance on the property from exchange of contracts, the property is still owned and insured by the vendor until completion and hence it is they and their insurers that have the primary responsibility for repairs.

You should probably get the work done and submit an invoice to your vendor for settlement (who would then claim on their insurance). If all fails, you have the right to claim on your own insurance, providing this was in force at the date of the storm.
