Q:We have just moved into our first rented house. The EA said they put our deposit in one of the schemes and we paid 1 months rent in advance. They also took an extra £100 which they hold in their account, which they called holding money. The EA said the holding money is held by them to the end of tenancy as rent in advance and will be returned at the end of the tenancy if all rents are paid to date and that this money does not form any part of a deposit.
What if the EA goes bust? How would we get out £100 back and our interest?

Hi Jill – don't feel bad about it. You recognised the problem, and got it dealt with. There's nothing wrong with asking for help – it's far, far better than just ignoring the problem.

The £100 has been given back to us as my father got his solicitor to write to the agents. He pointed out that this £100 should have been put in the deposit scheme with the rest of our money and should not have been kept by them. At the same time he also got the landlady to do her repairs, which she had refused to do. We are going to move out at the end of the 6 months contract as we don't trust this landlady anymore.
I feel a bit demoralised about all this as I had to get my father to help when we were trying to stand on our own two feet for the first time.

If the EA is a member of the NAEA they have to follow very very strict rules about taking and holding deposits.

You need to trust your instincts in situations like this, and if you don't feel like your landlord is trustworthy, moving out is the right thing to do. And I'm sure that this will give you confidence in the future – fingers crossed you won't go through something like this again!

I phoned the deposit protection scheme and they agreed that it was a deposit and didn't sound legal. They said that they couldn't give legal advice and that I should seek this from the CAB or a legal helpline on my contents insurance.

How to Buy a Home with a Months WagesA:I'd call up one of the deposit protection schemes & ask if this is legal. Since I can't see how the £100 isn't a deposit. If that doesn't work, try calling ARLA to see what they say.
