Q:Yesterday our neighbours broke our fence. There was a massive bang and a gapping hole appeared. It could of easily hit my 7 month so you can imagine how angry I was.I went round and did loads of shouting and my language was less than polite as you can imagine. They just basically ignored me and said Id broken the fence.Anyway Im getting off track.I rang the cos they rent and explained what had happened. He said he would come today.Well he did turn up but if I hadnt been outside of my front door he wasnt gonna come round. So I asked him what he was gonna and basically fobbed me off.Saying they need to pay for it as it was their fault. But surely he is responsible for their actions and he should reimburse me and then get the money off them.Cos I dont see why I should chase after them for money when he should be doing it.Or am I in the wrong thinking that??? Also if it his responsibilty are there any websites which state this so I can print it off. Many Thanks x

A:All i have been asking on this post is where do i stand about getting my fence fixed and who if anyone would be responsible the or tenents.to me that isnt getting anything out of proportion. And why am I being classed as irrational I dont know. But DFC hadnt read the post properly before she started to attack me.Anyway thanks for the 1st lot of posters who did give me some advice it was very much appreciated.

A:cupc – in the greater scheme of life –

the tenants next door are never going to fix your fence – whether they damaged it or not as they will be gone in a few month s

the of next door is never going to fic your fence otherwise he would have suggested doing so already

if you dont want next door neighbours peering into your garden/house whatever ;, then you will need to fix it your self

thats life = and no it aint fair

you could then try to sue the LL – but you have no witnesses as to WHO damaged it – so you will get absolutely nowhere with it

just fix it, grit your teeth, grin and bear it and move on

you have got this out of proportion – that is why DFC was asking you to calm down and be rational

A:Im sorry if I seemed to have offended you in anyway Debt_free_chick.I am only asking advice.I did say in a previous message that it is MY fence. And I did state that they broke MY fence.I do own my property.I also wasnt the 1 who suggested going to the police. If you had read the post correctly it was guy who said contact the police. So before you start attacking me you need to read the post and also the advice I have been given beforehand.

A:To be honest I wasnt sure whether the police would do anything.I didnt see who did it but there were only 2 of them so it was 1 or the other.

Sorry, but you need to calm down and get a grip.

What fence is this? Do you own it and someone damaged it?

Does your neighbour own it?

What does your lease (if you rent) or your deeds (if you own) say about maintaining any boundaries?

Would the council do anything if its privately rented??

No

I dont know whether this would make any difference but this has had with problem tenents before. It got to a stage where the police were called. So if I spoke to the police do you think they may take a grim look at him cos of other tenents he's had.Sorry to be asking so many questions but Ive never had this prob before so Im a little blind on what to do

No. Bad tenants do not make a bad .

Let's get the facts straight, then we can advise you.

Do you own? or rent?

What do your deeds/lease say about any boundaries/fences.

Please – calm down and give us just the facts.

A:After police go to council and see what they can do.

Our PCSO is quite happy to ring landlords up and harrass them about things. She's a star! So perhaps ask the police to get your local pcso to call

A:Fence panels, when given a good, hard kick can make a banging noise that can easily be confused with fireworks going off, or even gunfire.

A:Report the damage to the police. Get a crime number and claim against your insurance – who might then in turn ask the neighbours for the money.
but be prepared for the police asking if you actually saw who did it.

The question is, WTF made the whole?

A bang and a whole in a fence sounds like gunfire.

I'de advise the police that you think the people next door may have a gun as you think they shot a whole in the fence.

People are more co-operative when armed police kick their door in and spray them with CS gas.

A:Yeah its my fence.I dont want to fix it myself cos i know i wont get the money back. And I dont see why I should put my insurance premiums up cos of some idiot who cant hold his beer. But shouldnt the get it fixed and then get the money off them?? I dont particulary want the money all I want is my fence fixed

A:Is it your fence?

You could repair it and bill them. Then spend months taking them to court for not paying you. (50 quid I think and one form and lots of fun! But expect neighbours to then be awkward. Could be worth it if they left perhaps)

You could ask them to fix it.

You could them ask their to fix it, or send him the bill. None of this is going to get your fence fixed.

Report the damage to the police. Get a crime number and claim against your insurance – who might then in turn ask the neighbours for the money.
but be prepared for the police asking if you actually saw who did it.
