Q:My ex landlord in Glasgow paid me £200 but keeps stalling me over the remaining £400 of my deposit (moved out 1st july 2007). I have made occasional contact with him, but he rarely picks up the phone and never calls me back when i leave messages. when i DO manage to talk to him he says yes, he will pay me tomorrow or he paid the money into my account last week – basically he lies to keep me off his back.
He is not claiming that I caused any damage or breakages (I left the flat in better condition than I found it) and seems to accept that he owes me the money fair and square, but he clearly doesn't intend to pay me. The nonchalance of his attitude frustrates me intensely and I'm at my wits end over what to do next.. I never signed a lease with him so not sure how that will affect my case.. anyway, I am ready to take whatever action is necessary and I need advice on my next move.
I wouldn't be surprised if he is 'illegally' renting his property, ie. not on the landlords register, but despite me threatening him to call the local council and report him, he seems unconcerned.

From 6 April 2007, when you pay a tenancy deposit for an assured shorthold tenancy, the landlord or letting agent must protect your deposit (http://england.shelter.org.uk/advice/advice-7507.cfm) through a Government-backed tenancy deposit scheme.
If you paid your deposit before 6 April 2007, and you think your landlord is keeping it unfairly you may have to negotiate with your landlord or take them to court to get your money back.
The above does not relate to Scotland, where the law is different, there is no Rent Deposit Scheme in force in Scotland.
Download forms from here ,http://www.scotcourts.gov.uk/ (http://www.scotcourts.gov.uk/) fill them in, and send with a letter giving the LL, SEVEN DAYS to pay the balance of your deposit, if no payment is forthcoming, then lodge them.
Log on to this site, check if the property is legally registered! a sheriff may take a dim view if a LL has not registered a property, and is illegal.
